A Los Angeles federal judge gave preliminary approval for a $26.3 million dollar settlement for a class-action lawsuit against celebrity stylist Chaz Dean and marketer Guthy-Renker over Wen hair care products. This will now go to a U.S. District Court judge and if it is approved, roughly six million people may be awarded up to $20,000. Wen Mass Tort

According to the Wen website, The Wen Cleansing Conditioner claims to “eliminate the use of shampoo and its harsh detergents and chemicals. Wen Cleansing Conditioners replace shampoo, conditioner, deep conditioner, detangler, and leave-in conditioner – giving you five products in one bottle”. Unfortunately for a large number of consumers, this has been a horrendous and painful experience.

As of July, the FDA has received 127 consumer complaints. This is the largest number of reports ever associated with any cosmetic hair cleansing product. Since then, more than 200 more complaints have poured in. Not to mention the 21,000 complaints reported alone to Chaz Dean and Guthy-Renker.

The Wen Cleansing Conditioner has been reported to cause hair loss, scalp irritation, balding, and hair breakage. Attorney Amy Davis states:

“From what we understand about the product and how it causes hair loss is it contains virtually no cleanser. It’s like using lotion to wash your hair. So instead of removing the product when you rinse it off, it just becomes impacted in your hair follicle.”

Among the many consumers who have suffered from such side effects as balding, scalp irritation, and hair breakage were children. An eleven-year-old girl used this product only 3 times and noticed large bald spots on her head. Her hair continued to fall out until she was nearly bald. She suffered extreme emotional distress from being taunted at school and is now home-schooled. But The Wen Company stands by its product stating:

“Wen by Chaz Dean is safe, and we continue to provide our hundreds of thousands of customers with the Wen by Chaz Dean products that they know and love. Since the process of litigation is time-consuming and costly, we made a business decision to pursue a settlement and put this behind us so that we can focus on delivering quality products.”  

Even after the numerous accounts of physical and emotional damage, this product has caused, Chaz Dean claims that these products are safe and has every intention to continue selling these products. Thus far, there have been a grand total of 327 FDA complaints against this product. That only includes those who have registered with the FDA and over the course of time more are sure to be reported.
